The federal "justice" system isn't constrained by the state that the prosecution takes place in. Federal prosecutors sought the death penalty for Massino in the Sciascia murder and they also did with Basciano. If I'm not mistaken they said that they would pursue it in the Zottola case if they get a conviction.

There is a litany of things that are then put in place if it becomes a death penalty trial. The defendant gets up to three (3) lawyers for his defense. Gotcha. Even then only 16 federal executions in the last 60 years and 13 were under Trump. Nothing more than a scare tactic that obviously worked against him.
