well Vinny Basciano was tight with the father. He can now put a hit on the son in the can with his connections there.

The federal "justice" system isn't constrained by the state that the prosecution takes place in. Federal prosecutors sought the death penalty for Massino in the Sciascia murder and they also did with Basciano. If I'm not mistaken they said that they would pursue it in the Zottola case if they get a conviction.
NEGATIVE! If the feds were going to seek the death penalty they have to do so before the trial not afterwards. There is a litany of things that are then put in place if it becomes a death penalty trial. The defendant gets up to three (3) lawyers for his defense. And one has to be an attorney who specializes in death penalty cases. So facit accompli! No death for you!

Massino was being prosecuted by the feds not the state of ny

Gotcha. Even then only 16 federal executions in the last 60 years and 13 were under Trump. Nothing more than a scare tactic that obviously worked against him.
