New York got rid of the death penalty in 2004. Never understood why Massino flipped over that when the last NY state execution was 40 years earlier.

The federal "justice" system isn't constrained by the state that the prosecution takes place in. Federal prosecutors sought the death penalty for Massino in the Sciascia murder and they also did with Basciano. I've never read of someone in my life trying so hard to get their own family members killed. I can't imagine any lawyer or anybody feeling any type of loyalty to this guy. I mean it's not like his father was doing anything so egregious we heard about it.
