Since these things were moved to Graveyard...here's Gravano's affidavit again..2 snippets from 2018. As well as the governments motion on 5-21-20 (a portion) and an FBI report ala Massino....all related of course to Locascio's case

When I went into Pacer today to pull all the other documents, it wasn't even up there...there's a whole lot of documents not listed from 2018 but this was an exhibit in Locascio's motion for evidentiary hearing that was on 3/23/20, I think. There were 8 exhibits attached, this was one of them.

There were also some judge changes. Locascio had requested recusal on two I think before it got to Glasser.

That's a nice neat convenient statement from Gravano 26 years after the Trial. However, under the RICO Statute which is how LoCascio was tried & convicted by a jury of his 12 peers, it won't matter. According to the Statistics of Habeas Corpus Petitions Filed, less than 2% (1.8) are successfully released from prison. The defense lawyers will only make money from it by presenting a weak case with a 98% chance of failure, especially involving a high profile Organized Crime Figure (Frank LoCascio) involved in a sophisticated high level ongoing racketeering conspiracy.
His Defense Lawyers should have presented this kind of evidence at the original Trial. However, even then, under the RICO Statute, it would not have mattered.

In addition, I'm sure the Prosecution will present the evidence that Gravano & LoCascio planned to kill Gotti if they were acquitted. Gravano testified to this during the Trial. They were going to have a celebration party & LoCascio said to Gravano " I'll even bring him to the Party as long as I am the shooter".

LoCascio is right where he belongs and aint goin' nowhere.

They weren't aware of this. They couldn't bring it up at trial. I believe this is mentioned in Locascio's response to the prosecution's opposition which is posted up in FBI files.

How could they not be aware of it? Wouldn't LoCascio have told his lawyers that he tried to stop the murder or that he had nothing do with it so they could cross examine Gravano about it at the trial?

Supposedly gotti told locascio lawyer If he focused any of his defense specifically to get locascio off he would kill him. It was in one of the appeals and the lawyer confirmed that’s why he didn’t question certain things

Reread Gravano's Affadavit. It spells it out. And again, it's all laid out in Locascio's response posted in FBI files. The whole thing is there.

Yeah I vaguely remember reading that. That appeal was denied. And really it is LoCascio fault because he went along with it (if it indeed happened). He could have easily told the court and LE that Gotti is threatening his lawyer but he remained silent. He shouldn't be allowed to use it as a Get Out of Jail Card now.

What appeal are you talking about? It was just filed 5/21/20....
And also the judge hasn't ruled on the evidentiary hearing yet...so there's no denial.

He has had appeals denied in the past. I know I've the Gotti threatening his lawyer thing before.
