Frank Locascio Evidentiary Hearing.
So this seems to be heating up some....After Gleeson and the government filed their opposition...Locascio's attorneys shot back last week Wednesday....and say.......that Gravano is willing to come in and testify about all of this....This was a declaration attached to the 32-page motion in response to the government on 5/20.
So at the end of the document is Locascio's conclusion:
CONCLUSION
Mr. LoCascio is innocent of murdering Louis DiBono in order to maintain his
role in the Gambino family, a crime for which Mr. LoCascio is serving a life
sentence. The Court should hold an evidentiary hearing at which Gravano, the
government’s star witness in the case, can testify about new evidence that the jury
never heard. That record would permit this Court to evaluate Mr. LoCascio’s claims,
which if proven, would clearly entitle him to habeas relief.
The FBI is about to be EXPOSED....So it makes me wonder, if Gravano didn't testify truthfully about all he did to put all those 32+ guys away like he did....does that mean that alllll of those cases should be reopened, even the ones for the guys who already served their time?
I'm sure that the judge's response will come this week....interesting indeed.

Also...and I forgot to add this...the lawyer Locascio hired...the federal judge from Boston (I think I have to go back) she feels so strongly that she filed motions so that she could work the case in NY with Fick and associates. I'm going to have to do some research on Gertner.

The declaration says shit about the Louie DiBono murder. How did these lawyers reach out to Sammy? How much is he being paid for his testimony? Something doesn't smell right and it doesn't pass the smell test.

I honestly mean no offense, but it seems like you believe that EVERY SINGLE mafioso is a victim of the system...Being a member of the mafia may not be a crime by itself, but it shouldn't be a "get out of jail free card" either.

I'm sure I can think of many cases where that's the case. But why shouldn't the cases where there is clear negligence or misconduct be exposed? Would you be complaining if Capeci shared this information?

Also I didn't say that all 32+ should be freed. I speculated on whether or not those cases should be reopened because of what's going on with Locascio. I personally think Gravano lied about a lot of things. And I base that opinion on my research on Cherry HIll and how Comey had gone to all these other informants -- a whole list of them and then when they didn't do the job, he reached out to Gravano who suddenly remembered about that guy (his name is lost to me at the moment) that John Gambino had killed. So, I think in some instances that Gravano might have bent the truth like the Government wanted them to in order to secure some convictions. The Gambinos were definitely targeted early on since when they first arrived in Cherry Hill. And I'm not saying they weren't doing what they were accused of....but the evidence was lacking. Even when Rosario Gambino was convicted in 1984 (I think that's the date)..the evidence was only a $100 bill found in his dresser and then a surveillance photo of his car in front of Caffe Milano...no pictures of him even though his cousin used his car frequently. And also at this time, Rosario had no prior felony convictions, yet he got the maximum 45 years.
I understand that the government's main target in those cases was Gotti, but I think that because Gravano was a government witness and signed a cooperation agreement, he had to tell them everything they wanted. Tehre is documented evidence (in Crea's case for example) where the FBI will ask a witness to go home and "think about" a particular defendant or target. So, I think that's what happened in this case.
Why Gravano decided to do this, I don't know. If I remember correctly, Charles Carnesi was the one who contacted him initially about it. And I'm sure (again, I'd have to do some research as I'm only looking at what's happening now) there was something that stuck out with Carnesi that would have had him contact Gravano about this.
