FBI File Frustrations
Hello all...
I had a page from the FBI regarding the Rockford branch of the LCN from the late 1980s and early 1990s. It referenced a sub file that contained all criminal intelligence information on its LCN members and associates. On November 7, 2017 I requested this sub file and kept track of the FBI's processing of the file on its website. Today, exactly two years later, I received a response stating, "The material you requested is exempt from disclosure pursuant to 5 U.S.C. SS 552 (b)(7)(E). These records are law enforcement records the release of which could reasonably be expected to interfere with enforcement proceedings and risk circumvention of the law, therefore, your request is being closed."
WHAT THE HELL? We're talking about records/information that is around 25-30 years old plus what is with the excuse that its release could interfere with enforcement proceedings? The letter goes on to state that I can file an appeal, but what are the chances it will go in my favor?
Has anyone had any success with appealing records such as this or is it even worth it to try?

I feel your pain, cavita. The only person I know of who sued and won was Angela Clemente, who had a high-powered lawyer who was an expert in the FOIPA law. She obtained the release of the Greg Scarpa files, but they were still heavily redacted.

I think she appealed it and got a second batch with less redactions, but they still take out too much.

What's the proper route when filing an appeal? Just typing a letter saying, "Hey, these records are 30 years old, what ongoing investigation could it jeopardize?"
