Both Philly and New York have had good luck at trial the past few years even when there are CWs and LE with less baggage than this one. Juries have seemed less impressed with anti-mafia investigations for whatever reason(s). I would guess Merlino and his lawyer are well aware of this. He's also a known risk-taker and gambler, so it's pretty typical of Merlino to throw all of his chips in and try to stay on the street, especially given the possibility that he could be hit with charges from other investigations at any given time.

Under two years is tough to pass up, especially when you know you are guilty, and it's hardly inconceivable that a jury would convict
