Supposed upcoming racketeering indictment on Lucchese hierarchy
From ganglandnews and I believe the Manhattan D.A. admitted in court when they were upset about Pennisis blog that they been building a racketeering case against
Lucchese boss Michael (Big Mike) DeSantis and underboss Patrick (Patty Red) Dellorusso for two years now and counting... what can they possibly have on these guys? What would be left of the Luccheses and what does it feel like knowing your going to be part of an upcoming federal case similar to RICO, anyone want to share? And why the D.A. admit that? You think they know it already from their attorneys? And is there anything you can do to minimize the severity of your sentence or charges knowing they are coming?

I’m no lawyer but I’m pretty sure there’s nothing they can do to minimize the severity of the sentence. My guess is they pray for a sweetheart plea deal or hope the feds botch the case like with Merlino and Cammarano.
I also wonder what they do with a heads up for indictments too can’t exactly go on “the lam” anymore. I’d assume if they where smart they would start handing the reins over to some capable guys but who knows

The Lucchese family is still fully functioning, with around a hundred made members.
The case will probably be a standard mob case with racketeering, illegal gambling, loansharking, and extortion charges.
At this point there's nothing they can do to prevent themselves from being indicted, given that they are all career criminals and have already committed the crimes that they will likely be charged with in the upcoming indictment. The only thing they can do now is try to be careful and avoid giving the prosecutors more ammunition.

Is there statue of limitations on any rico predicates? I know not murder, obviously.

If they can prove that a pattern of racketeering activity has continued within the last five years, they can charge you with crimes going back decades.
Despite the fact that the statute of limitations had run out on the individual crime, they were able to charge Bonanno member Vinny Asaro with the 1978 Lufthansa heist in 2014—because it was part of a pattern of racketeering activity that extended into the present day.

It would have to be part of a pattern of criminal activity that has continued within the last five years. So, for example, they could roll a bookmaking charge from 1999, a wire fraud charge from 2010, and an extortion charge from 2018 into a RICO indictment.
If you ran a bookmaking operation in 1999 but then retired from the mob in, let's say, 2000, and hadn't committed any crimes since then, they couldn't charge you since the statute of limitations would have run out on the bookmaking charge.

I remember one of charges against DeCavalcante members Joe Collina and Jerry Balzano in their 2011 indictment was that they had moved stolen video games back in 1994.

Now that I think about it I believe it was some Colombo guys who where charged with moving stolen video games in 1994 as part of their 2011 indictment. It was all part of the Mafia Takedown case.

with the recent convictions of Crea, Sr, Madonna, et al - maybe a cooperator has developed to give more ammo to the govt? Your'e in your 70's, covid killing everyone around you and you are looking to spend the rest of your life in the hole in Kentucky or AlAbama - suddenly what Joe Massino did makes sense.

Rudy Giuliani is a bitter disappointment.
