A wrongful death suit would be filed by whomever acts as the representative (executor or administrator in many jurisdictions) of Bulger's estate. The action would be on behalf of his designated beneficiaries or his heirs, whomever they would be. If no children, no parents, than his siblings would be next in line under succession by law. He could have designated anyone he wanted under a will though. Might be Catherine Greig or he might not have made out any directives.
Soon we would know because they will have to file on behalf of his estate on behalf of an appointed representative if he left a will. If not anyone interested could petition to be appointed his representative and then any asset of the estate not required to be paid to creditors would go to his heirs. A lot of moving parts here.

But if he created a “Living Trust” they will never be made public. Living trusts do not go through probate court. Nope. Bulger has a wrongful death claim. Distinct from assets transferred to a living trust prior to death. Wrongful death claim lies with decedent, can't be transferred to a trust, especially since wd claim vests at the point of death. Living Trust is worthless in this situation. I appreciate the ingenuity but tour answer is a law school answer and you're wrong. I've done this for years and I know exactly what I speak.

If a living trust was created and intact for a period of 5 years (the federal look back period), whatever assets are in that trust are not made public and do not go through probate. I never said anything about a wrongful death claim being transferred to a trust. I should have been more clear. Federal look back period? That applies to Medicaid and like government benefits. And the issue isn't probate either. Just because the assets placed in the living trust don't automatically pass through probate doesn't mean they can't be reached by the victims of his crimes. We are talking about judgments, either for criminal restitution or civil judgments that the victims have against Whitey.
A "Living Trust" cannot be used to avoid personal judgments any more than you can shoot someone and then the next day you transfer property to your brother to avoid having to pay your victim. An irrevocable trust would have had to be created by Bulger PRIOR to the events giving rise to judgments against him. I hope you have never advised someone that the way to avoid judgments or debts is create a "living trust" because that's simply incorrect.
