I say this because after the Ligambi and Borgesi trials in which the government and almost everyone else felt they were going away for ever, the government will not chance another loss even with tapes. They will take the plea and get the conviction, another loss would seriously hurt the government in future mob trials, in my humble opinion.
I dont think Merlino will ever be tied to the DiPietro hit he has a knack of staying just far away enough from that , on the other hand ....
Preet Bharara, the United States Attorney for the Southern District of New York, Diego Rodriguez, Assistant Director in Charge of the New York Field Office of the Federal Bureau of Investigation (“FBI”), William J. Bratton, Commissioner of the New York City Police Department (“NYPD”), and James A. McCarty, Acting District Attorney for Westchester County, Are all looking for a medal of honor there all publicity hounds , They Got Merlino as one of three boss's of the so called almost comical "East Coast LCN Enterprise" ...Preet Bharara is looking to move up to the Governors mansion , My gut feeling most these guys go down hard as hell for mostly political reasons more then what crimes they committed, The so called "East Coast LCN Enterprise" Bosses go down Hard , I dont believe any real pleas at the top of the ticket will be entertained as viable good deals just juxtaposing there will be a trial . Anyone whos been watching Preet Bharara knows he wont flinch at any power play from the rest of the alphabet soup or lawyers , There was also crazy amount of Violence and tapes in the indictment that wont help a plea ,Parrello 73 years old is facing 40 years max even if he gets 15 its life for him ,O’Nofrio is 74 facing 20 a plea for him would be close to life if not life , Merlino at 54 years old is in the drivers seat he could do the whole 20 minus time served and 15% good time he would max out at 16 years as of today if he blows trial,
