If I remember correctly he was identified as a captain in the Ligambi case. He was still running things on the street through Monacello but he had no made guys under him. Kind of like how Chickie Ciancaglini kept his rank after being locked up in 1983 but the made guys under him were sent to Salvie Testa. When Borgesi is released he is reportedly demoted to soldier and then promoted back to capo around 2016

Merlino has NEVER been into the heavy stuff of organized crime. No labor racketeering, major narcotics, construction etc. NY doesn’t give a fuck about the half pint, he’s a pimple on their ass compared to who they’re watching. You could be right there, but I'll stick to my point that the NY office indicting Merlino doesn't necessarily rule out the Philadelphia office working on something at the same time. Offices almost never like working together. Glory hogs, never communicate
