I dont think,governor Rockfeller in 1965 limited the death penalty to the murder of a cop, but the Supreme Court with Furman v. Georgia stopped the death penalty in all the States.
I think that Farace would get the life.
I assumed it would have been a federal death penalty case, believe death penalty was reinstated by Congress in 1980s. Again, it’s rare to see. I remember the Staten Island gun runner who executed two undercover detectives was sentenced to death, reversed, sentenced to death again I think, and reversed again to life in prison.
