The Judge who denied the motion to be released outlined his whole argument perfectly & clearly & made the defense lawyer's motion look silly.
224 months instead of 240 is no break, and they the judge did have it out for him by kicking it back to the BOP. They do that to make you go through more crap, it's why our system moves so slow.

Seems like the feds and the entire court system have a hard on for Tommy. There’s no way he can get back into the life after he’s released. He’s a marked man for the feds so his best bet is to retire once he’s out. Tommy had a good run while it lasted.

The judge knows the BOP is going to never let him out, so he is just playing games and screwing him over. Or it
came to the judge and he felt Tommy G he deserved to get out, but was afraid to say so.
The guy is clearly vunerable to covid and these judges who never want to take a stance and kicking the can back to the BOP who are already understaffed, overcrowded, lacking proper hygiene for some etc need to be proactive. You want to let him out for 30 days to avoid spreading this thing, good. You want to seclude him from gen pop which would be difficult given the maxed out BOP as it is, fine. You dont give a fuck if tommy g catches it then say that too. Putting the responsibility back to the BOP does not show leadership qualities considering all the customs and curiositys judges receive based on their position.

Not all that surprising I remember reading the post Gohn did for Gioeli and was surprised at all the stuff he was involved in. He had a long run on the street and did well for the Colombo’s.

Here is what the article said. The wording is indeed strange.

He was convicted in 2012 by a federal jury in Brooklyn of a conspiracy involving three murder plots, two of which involved the deaths of mob associates during the so-called “Colombo Wars," between factions of the family headed by Carmine Persico and Victor Orena.
He was - IIRC - convicted of racketeering conspiracy, which carried a maximum sentence of 20 years, and the predicate murder conspiracies in furtherance of racketeering. I believe Gioeli himself was found guilty of ordering or approving the Frank "Chestnut" Marasa murder conspiracy in 1991 and the Conspiracy to Murder Members of the Orena Faction, which was a loose conspiracy charge covering the two-year period of time during the war. I can't recall if Gioeli was also found guilty of Conspiracy to Murder John Minerva or if that was encompassed in the Conspiracy to Murder Orena Faction Members charge.
*Edit: Judging from the article excerpt you posted Pogo, it appears the Minerva conspiracy charge was indeed separate to the "Orena faction" conspiracy charge, meaning Gioeli was found guilty of a total of three murder conspiracies (but not the actual murders themselves).

One of the reasons why Gioeli got off lighter than Saracino is because he wasn't convicted of actual racketeering, just conspiracy charges, carrying a maximum term of twenty years. Dino Saracino was convicted of racketeering conspiracy as well as other racketeering acts like his witness tampering charges, which were added consecutively to create a 50-year sentence for him.

** referencing the “victories” in both the Colombo and the more recent Bonnano trials. its insane that people like Calabro and Lovaglio who were really in the mix, receiving and giving orders, etc. were found to unbelievable, but (I hate to say it, and im not trying to stir up shit) up in Westchester a case was propped up by arguably some of the worst witnesses of all time

bottom line, Gioeli got lucky. If i were in his situation id take a look in the mirror, take a look at my gynocomastia, and make good use of the time. get a routine, a trade, some hobbies, find god, whatever...but better yourself the best you can, and eventually come home to live out your golden years. instead he starts teaching a master class at “slip and fall school”

Frankly he should just be happy he didn't get charged for the Dols murder, the Cutolo murder and everything else.

He got lucky. He could have just went in, shut the fuck up about it, and made the best use of his time as possible ... maybe get a little program & routine going, exercise, TRY to eat as good as he can, and that's it.

He's in bad shape for his age and all of those ailments he brought upon himself by eating like shit and not talking care of himself. He literally got away with murder, and yeah as slimy as the feds can be, instead of just taking the time and making the best of it like the bosses before him (ex: Persico tending a rose garden and playing the drums at Lompoc) he starts blogging and starts slipping and falling. It's disgraceful. I can only imagine the type of stickler he was on the streets, i would bet everything he was a cheap bastard
Just for the record, he was indeed charged with the Cutolo and Dols hits.

sorry, i meant convicted of the murder charges.

afaik he wasnt convicted of any of the murders technically. thats correct right? wasn't it “just” a racketeering charge he was convicted of (that stated he was at the helm of an organization that used murder as a furtherance to the overall grand conspiracy?)

i think my point was made though, the guy could have easily sentenced to natural life. its amazing that he didn't.

i think its beyond blaming simply the “shady witnesses” and the jury not liking them, that seems like an easy out and im sure there was more at play...but its crazy that people like Calabro and Lovaglio were found to be unbelievable when they were literally right there, for ages
