Yes, those are the same thing. But that wasn't what was going on. The moose lodge itself wasn't being shaken down. A mob-connected company had it's machines in the lodge. The lodge wanted to replace them by going with a competing company that would bring in newer machines. Spagnolo, who had been receiving payments from the original company, made sure their machines were kept in the lodge. Technically speaking, extortion charges were brought (as they often are) both the mob-connected company and the lodge were sharing in the profits of the machines.

As for Constitution, despite the extortion charges which legally can be brought, it's really a mutually beneficial arrangement. Not like the company is simply being shaken down for nothing in return. They are paying for protection for their machines, which is exactly what they got in this case.

May not bring in millions but if i was a 70 something year old wise guy i wud rather have 5-6 guys giving. Me a Gnote A month than go get a job a market basket . If you had originally said Spagnolo was shaking down a video poker company - and not a lodge the company's machines were placed in - that would have been closer to the truth. Anyway, technically it can be charged as extortion of protection payments. I'm simply saying that it was mutually beneficial because the company did have the mob supporting them against a rival company.

The only reason they paid is because it was in there best interest to pay , if they dont pay there outdated machines would of been sledgehammered and thrown in the street. This whole case was brought on because the guy who wanted to put his new machine in there, phone was bugged and he was talking to the moose lodge manager about the visit from Spagnolo . both told the feds they were not afraid but why didnt he move the new machines in then?
