I followed the news articles and have been in criminal federal court, he has a better chance of having the conviction tossed and getting a new trial than getting the sentence meaningfully reduced unless there is some retroactive change in the guidelines sometime down the road. His was because this was his third federal felony. Same for the Pelullo.

I bet there is a lot of politics happening here. You have Scarfo asking for his release to Philly...now he's asking for this release but why? He asks for the release while Joeys away, doing 12 years. Maybe Jr. says it through his father to Amuso or outright to his superiors but clear the release is to allow him to go to philly and align some more guys and make a play for the top spot. We know his father was agitating for years for him to do this. We know he talked to multiple guys including Joe Ciancaglini and Joe Grande. Joe Pungitore came to blows over it so word clearly was out at the time. Scarfo Jr. probably figured without Borgesi and Mazzone that Joe Ligambi wouldn't have the muscle, with shooters or political, to resist. '

We know Philly asks for a sit with the Gambinos. My guess is that Philly is either aligned with the Gambinos or the Jersey Gambinos held sway with the Lucheses. Who knows who else they sat with. The meeting covers Scarfo Jr. making his play, consolidating Philly guys still loyal to his father, some even made guys like Joe Grande and a request to kill him for it. Word is out that Scarfo isn't getting his release, got demoted and he's headed to Texas. Luchese's get taxed for giving Jr. the platform and not reigning him in. I suspect there were plenty of guys in the Luchese Jersey side who thought it a bad move but Scarfo was answering to Amuso through his father. Some of Scarfo Jr''s guys get moved back to Philly where they started and Jr. is shut down so he puts his efforts into he stealing 10 million and gets 30 years.

Anastasia should write it up in a final book once the Merlino guys get indicted again. You have to give credit to Scarfo and Jr. for making the play and you also have to appreciate the political chops Merlino and Ligambi showed in blocking it.

I forgot to add this sentence. Philly probably wanted Scarfo released so they were free to kill him in order to resolve the matter. Luchese's don't release Scarfo Jr. probably as a favor to his father through Amuso and just break him back down to soldier and strip his crew.

Merlino absolutely despises Nicky Jr- has failed once at personally killing him at Dante & Luigi’s in 1989 and then was looking to whack Nicky Jr again in the mid 1990s before he got indicted. Nicky Jr is probably lucky he’s not in the streets now since Joey got out.

If he wants to try and get the conviction overturned, Section 391 of the Criminal Procedure Code allows the Appellate Court to consider NEW evidence, if it deems necessary. The Defendant has to explain in the Prayer to the Appellate Court why the evidence was not produced in the first place. Best way to do this is hire another Attorney and claim your first Attorney did an inadeqaute job for your defense.The other way is for your Attorney to prove to the Appellate Court that there were errors made in the Trial and have it overturned as a mistrial. The Prosecutor then of course can have another go at it.
