Back when Pete was on the street, he did have authority. Surveillance caught him at meetings receiving tribute, he attended the last known Commission meeting, etc. As for now, that question was already answered by Capeci. I doubt Gene will be bumped up to capo as soon as he walks out of prison. I mentioned this in another thread but a promotion to capo isn't something you can hand out without a second thought. You have to either demote another capo or split a crew in half.
They might throw him a piece of the Cement and Concrete Workers' Union because of Gene's longstanding connection to Ralph Scopo Jr., and the fact that after Scopo Jr.'s death, the Luccheses and Gambinos discussed how they would divvy it up for themselves. That'a a bit of a stretch though.

It is to a boss’s discretion whether someone gets their stripes. They don’t have a set number of skippers or crews, it’s discretionary.
