It might have been worse for the prosecution if the defense had him to tear apart credibility wise etc
He could cobborate everything the prosecution alleged. They'd want him on the stand testifying to there standing in the Mafia.

Couldn't agree with you more Chucky. If Stefanelli testified, Ligambi & Co would have been locked up
Always felt that way. It's easy to play tapes, it's another thing entirely to have them corroborated by someone who was there in the room with them. Instead they had guys giving their "expert opinions" on conversation being played, gives defense attorneys more reasonable doubt.

Not having Stephanelli to testify was HUGE deal. Huge. Probably saved 30-40 indictments. They brought the tapes into Ligambi's trial because they were being used to establish that he was a member of organized crime but was not being used to establish that he had committed specific crimes. It was kind of a test run to see if they could use his tapes for context but without Stephanelli to provide the actual agreements, conspiracies etc. they didn't have much.

Well in Merlino case it’s quite obv he’s guilty and he never left the mob
Gotti on the other hand was not on tape and actually did quit
Correct-a-mondo.. I think a NY jury might convict Merlino. I think he is dumb to go to trial. But hey he like the attention.
Bingo Rocco! He’s in love with himself. A fucking disgrace to old school LCN. This guy is a fucking asshole, I hope the Feds get this douchebag off the streets and he gets a long prison sentence that is “for good.” Either way, his life is shit.
I agree. He should get 20yrs just for driving around in a White Rolls without a legit source of income. Shit for Brains. Best he could come up with is working as a Hostess in a restaurant. Open a fucking business with your money. And he is upset he got arrested. So stressed hes got heart problems. What did he think LE was going to do ? Buy him and ice cream cone and say have a nice day Joey ? Some guys have it...some guys just don't...
How the hell do you know he has no legit forms of income? Have you seen his financials? He isn't being charged with tax evasionin and Merlino clearly has plenty of legitimately wealthy people around him.

In August, Don Michael Petullo, a former Las Vegas businessman who worked in the casino industry, registered a company, DNS Inc., at Merlino’s Boca Raton address.

Wether he's driving a Rolls Royce or Toyota Corrola the Feds are going to after him regardless.
He doesn't just the restaurant. Which is now gone. If he had a business in his name it would be all over the place and the news. Merlino prob hasn't filed a tax return since 1986...
What makes you say that? How many mob guys have there businesses info "all over the place and news"?
If Joey Merlino had a legit business he would want it in the news. He would want everyone to know he is legit. He likes the attention. Why do you think that restaurant was called Merlino's ? Also you want your legit business known. Its your front. Its a must. What don't you get about this here?
That's all an assumption on your part. Just because Merlino likes attention doesn't automatically mean he would make all his business public.
On flip side all of your arguments are an assumption are your part. You do not know Merlino nor does anyone on the forum. Reality check. This entire forum is new articles and assumptions on everyones part..... So what the fuck is your point ? lol

dack2001 wrote: Tue Jan 30, 2018 4:58 pm My point is that the recording backs up Joey's theory of defense instead of the state's argument. Merlino says he is no longer with the mafia, just likes to bet. Saves guys now instead of killing them. I'm not arguing what's truth, just pointing out the consistency of the position.
They got him on tape asking for his fucking money. If he is not in the mob what the fuck is he doing having dinner with Capos in the Genovese Crime Family in NYC.? Lets wait and see what his defense attorney do . That haven't had their turn at bat yet. They should be up to bat this coming week. We have to wait and see what the defense does. If he isn't in the mob he's gots lots of explaining to do for the company he keeps... If they can demonstrate a criminal conspiracy he is toast. They don't need to catch him the in act for RICO. Also his defense that he thought the Medical Cream scam was legit wont fly. If it was legit he would have had a legal company with his name on it receiving the checks. Which was not the case. Merlino had no legal ownership in any company as far as I know.

You're assuming a lot of what's on the tapes...so far as we know all the tapes have is Joey eating dinner, waxing philosophical about killing guys (and his side will play the entire tape which Joey talks about saving guys) and asking Rubeo to lend him money. They have to establish that Joey was in league with Onofrio, Rooster was the one demanding his money, not Joey. Rackateering requires an agreement and two predicate acts. As I said a month ago, Joey's lawyer will hammer home the fact that Joey is in Florida and Ohilly and wouldn't know New York unless you bought him a plane ticket. The Feds will end up admitting they had to pay $25,000 to get Joey to come up for the meeting. Seem odd to you if he was collecting money that he would need someone to arrange a party to get him to come up? This case is almost entrapment. Jacobs as part of the defense is admitting Joey knows these guys and was a member of OC, just that he's retired now. And so far I see some daylight if Joey's lawyer is right and all they have on tape connecting Joey to Onofrio or Kreisberg and others is the word of John Rubeo, who conveniently didn't record those conversations...Joey is still the underdog but he's got a chance, just like the Eagles.

Dack is on point as usual. One thing we have heard for years is how
crafty Joey is when he speaks in person to other OC members/associates/wannabees. If Joey stayed 'in
character' during the tape recorded conversations, then the prosecutors are going to have to
have other hard evidence to connect their dots. Jacobs will surely dis-connect their dots as
adroitly as ever. That said, my gut instinct tells me Joey's luck has run out.

I posted a link showing that he had at least one business (aside from the restaurant). As in actual PROOF. You're talking like you know what the man thinks by saying if he had any legit business he'd want everyone to know about it and it would be all over he internet. THAT'S the baseless claim on your part. You stated it as a fact, not speculation.
