If he did plea out, is there anyway that an agreement could be made where the current charges can’t be used towards a future rico? Is that even a possibility?

I know for a fact that when Jack Licavoli went on trial in Cleveland in the early 1980's for one of the country's first RICO trials, he paid his lawyer a little over $450k. Time/hours, paralegals to help with research, expert witnesses, specialists to decipher audio tapes etc adds up in a hurry. And I believe that RICO trial was in 1982, 3 years prior to the infamous RICO trial of the bosses in NYC. If I'm not mistaken, Jack Licavoli was the first mafia boss in the country to be tried and convicted under RICO. His lawyer, Jimmy Willis, still pracitces law. I could see a plea to a federal misdemeanor gambling charge being worth it to Joey. He would live to see another day and the Feds would have his plea under their belt. Problem is, I'm sure they would need federal probation to get it past the Judge and I'm sure Joey wants none of probation. Looks like trial to me. The Feds may be wise to dismiss now, regroup with this Rubeo clown and indict Joey down the road in a philly rico case.

What difference would that make if he is the sole witness against him again? It's a quote from the move Gotti. It fits with Merlino's situation. He was saying that he's not taking a deal unless it's for a minor charge.
