Prosecutors seek change of venue for strip club owner, ex-DEA agent in bribery, sex- and drug-trafficking case

Prosecutors are asking for trial to be moved to Rochester.
Gerace had a “new” lawyer. Cohen was replace with one of the lawyers in his defense team who left because of conflicts… those conflicts were sealed and unknown to the public. Lawyer says conflicts have resolved themselves.
Court date moved back to January and Bongiovanni’s case will not be severed because delay not that long.
Here are some select quotes:
“This is no ordinary case,” prosecutors said. “Rather, the overwhelming media coverage – exacerbated by defense attorneys’ and anonymous sources’ statements to the media – the attendant threats and intimidation of government witnesses often following those news stories, concerns for the privacy rights and dignity of victims, and the challenges caused by selecting a jury in the Buffalo area, all overwhelmingly compel the conclusion that this is a once-in-a-generation circumstance.”
“The fact is the government continues to make bombastic accusations in its public court filings, which the U.S. Attorney and her subordinates know will be read by the public,” Singer added. “Do federal prosecutors honestly believe that the media will not – or should not – report on these filings? We also find it ironic how, only now, after prosecutors were accused of wrongdoing with a witness, did the government quickly move to transfer this trial outside of the Buffalo media market.”
“The government and defense witness lists have 400 names, and the case involves individuals who are well-known in the Buffalo area, including attorneys, political figures, businessmen, members of law enforcement and at least one judge.”

An Allegany County man who last month woke up next to a dead government witness in the Pharaoh’s strip club case is now the target of a witness tampering investigation, federal prosecutors said Thursday.
FBI raids house while investigating death of witness against strip club owner
Assistant U.S. Attorney Nicholas Cooper told a judge that his office intends to file witness tampering charges against Simon P. Gogolack 39, of Wellsville. Gogolack already faces felony charges of conspiring to sell narcotics, maintaining a drug-involved premises and three firearms offenses. In an indictment that was unsealed Thursday, prosecutors said the deadly narcotic fentanyl is one of the drugs allegedly sold by Gogolack.

Reminding people of timeline involving alleged witness intimidation.
1. In January of 2023 prosecutors express concern for the safety of witnesses in the Gerace/Bongiovanni case and ask to keep the names secret from Defense attorneys. "Tripi told the judge that he hopes to keep some of the witnesses’ names secret from defense lawyers and the public past May 10, the date Sinatra has set for him to submit a witness list to the court. That would be roughly six weeks before the trial is scheduled to begin on June 21. “Six weeks is a long time (for someone) to be whispered a name, and to be sent on a mission,” Tripi said.

Sinatra Jr. ruled there was "clear and convincing evidence that no condition or combination of conditions of release will reasonably assure the safety of any other person and the community," according to court documents." He had been accused of sending threatening Facebook messages to potential witnesses in 2019.

4. On August 1, 2023 Crystal Quinn is found dead of an overdose in Gogolack's Wellsville home. Quinn was a former employee at Gerace's strip club and his maid. Rumors abound that she was dosed. Media outlets indicate she was a reluctant witness for the prosecution of Gerace.
5. On August 8, 2023 the FBI raids Gogolack's Wellsville home.

A federal grand jury has indicted two men on sex-trafficking charges stemming from the Pharaoh's Gentlemen's Club investigation, which already has the Cheektowaga club's owner facing up to life imprisonment on the charges he faces in the high-profile case.
Brian Rosenthal, identified as a Pharaoh's employee in court records from an unrelated case over a decade ago, was indicted on conspiracy to commit sex trafficking, lying to the FBI and concealing a felony.
Joseph Barsuk was indicted on the sex-trafficking conspiracy count as well as sex trafficking by coercion, according to a court record.
Their arrests have implications for Peter Gerace Jr., the owner of the club, who faces up to life imprisonment on charges, among others, that he maintained Pharaoh’s as a drug-involved premises and victimized vulnerable women by exploiting their drug addictions in order to coerce them into engaging in commercial sex acts with him, his friends and associates.

That is a good question. I haven’t had a chance to do any digging to find out. If that is the case means Outlaws have been entrenched there for at least 10 years. Trafficking charges begin in 2013 in this indictment. He's been employed there since at least 2007.
