You'll find that kind of thing happens a lot because guys on the street don't use last names. You could know a guy for 20 years and have no idea what his last name is or you have an idea what it is because you heard it from a guy who heard it from a guy....Bellomo becomes Borello, Massino becomes Messina.

This motionisnot going anywhere. Interesting but it'a all bullshit. Vinny did a big no-no - putting out a hit on the federal prosecutor- Greg Andres. You don;t touch a cop or prosecutor in thelife. They will let him rot in the can just on that offense alone!

I always thought in certain states you have to tell someone there being recorded. Maybe it's just over the phone. Idk it's a long shot but I see the idea. He's lawyers up they sent in massino working as a agent to ask him questions. Sounds feasible

It most cases as long as one party consents (Massino) the recordings are perfectly legal.
The Basciano's argument isn't about him being lawyered up when these conversations took place. He's arguing that his 5th amendment was violated because he incriminated himself while under the threat of death.

Furio check out this post by Chin, he listed where every member is serving their time. Some of them have already been moved like Daidone and Stanfa so if you really want to know you might want to just plug all their names into BOP

So if an undercover cop buys drugs from a dealer and asks him or her where the source is - you have to step out of charatcer and give them their 5th amendment rights? Bullshit Vinny!

I believe if the Feds sent any other informant to Vinny and the same thing happened, his appeal wouldn’t have an argument. The Feds picked the one guy that could kill him for lying to him and thus they were using Massino as a proxy to violate Vinny’s 5th amendment
