Matthew Madonna and Steven Crea have won a hearing for a new trial
This information comes from Crea’s son, Dominic Crea who says that this is “positive” but not “great”
The hearing is to discuss a Rule 33 which is defined as “ (a) Defendant's Motion. Upon the defendant's motion, the court may vacate any judgment and grant a new trial if the interest of justice so requires. If the case was tried without a jury, the court may take additional testimony and enter a new judgment.” https://www.law.cornell.edu/rules/frcrmp/rule_33
This case began on May 31st, 2017. On August 27, 2020, Crea was sentenced to life in prison, along with a $400,000 fine and the forfeit of $1 million.
On July 27, 2020, Madonna was sentenced to life in prison for the Meldish murder, along with Londonio and Caldwell.

Once u get convicted in Federal trials it’s over…The chances of winning on appeal is EXTREMELY low.
Like Dominic said though it’s positive but not great
This case had a lot of things wrong with it.

So the judge ordered a new trial? Or ordered a hearing to discuss/argue the merits of ordering a new trial?

Yeah, from headline I thought new trial was ordered. This is an effort to convince the judge that presided over the trial to toss the conviction (not the second circuit appellate court). Very difficult to win. Has anyone ever posted the motion? Assuming it’s alleging some new evidence that contradicts the cooperator testimonies.

Capeci wrote some of the "new" evidence being used in the motion in a previous column. A lot of has to do with further discrediting Frankie Pasqua and John Pennisi. They brought up his story of his grandparents/Devine intervention that led to his cooperation as proof that he is unstable/delusional. They also brought up the point that Pennisi thinks the Perna's had something to do with getting guys to stake-out his house/get his pattern down which would contradict expert testimony in the Madonna/Crea trial that said only the Boss/Administration can order a hit.TSNYC wrote: ↑Sun May 08, 2022 5:38 am Yeah, from headline I thought new trial was ordered. Motion has some interesting stuff in it. Government conceded they have no actual evidence that Crea and Madonna ordered the hit. Basically argued that they HAD to have ordered the hit because they're admin. Garbage move, imo. Penisi said on a podcast that he considered killing a guy on the sneak without approval. Talked about other guys, like Pernas, who were capable of same. Penisi testified at trial that only admin could order a hit, which was a lie fed to him by the Fed attorney looking for conviction. Interesting motion that may have some teeth despite long odds.

The Judge in this case is Cathy Seibel, she was an Assistant United States Attorney for the Southern District of New York with the U.S. Attorney's Office from 1987 to 1991.
I’m sure she’s no stranger to the Lucchese Family and Steven Crea in particular.

You're probably right but getting this Rule 33 hearing is a step towards winning a new trial.
