You guys need to go read the article again because Jerry clearly states in each of those pieces that what he wrote was based on the 121-page filing (which he stated) along with 500 plus pages of transcripts which I'm guessing were podcast transcripts. It's clear if you read the article that he didn't watch the podcasts - that he got the information from the filing.

The prosecution always goes with the hierarchy argument. That no one dies without the bosses ok. Pennisi, thru his podcast and such, has said that murders could happen without the bosses ok. You can't have it both ways in the court so defense attorneys are now quoting Pennisi to benefit their clients.

I think expert is saying an actual approved murder, meaning it was approved by the boss. Not an unapproved/unsanctioned murder. Assuming some other evidence showed that this was an approved murder. And at time of approval, boss was Madonna. Sounds like some word parsing

Just FYI in case some of you don't know how motions are laid out. There is usually and index at the beginning which highlights all the various points included in the filing. So, perhaps Jerry looked at the index and then read the parts he wanted. I don't have a copy of the filing or the transcripts so I have no idea what's in it except for the information Jerry provided in his column. But what I do know is that the filing is on Pacer and accessible to anyone so you can see the index for yourself as I'm 99.9 percent sure that it's laid out that way as 99.9 percent of large motions are.

In addition, most motions will reference what was said in exhibits. So, I imagine all the transcripts referenced ala the podcast quotes came from the exhibits. In the motion, the narrative part of it will reference different parts of the exhibits to support the points being made. Then there will be footnotes of some sort where it'll say (ex. A, 110-120) or something like that so the judge can go to that particular exhibit and look at lines 110-120 for the documentation discussed in the motion.

as the formost internet layer of this board, i think crea sr wasnt probaly informed by the acting boss madonna meldish was gonna get whacked. theres no need but he got life just for being the underboss bascially like frank locascio who they had a tape of his boss ordering the murder yet locascio had no role in the hit.
