No Compassionate Release for Locascio

Post by mafiastudent »

Not surprising motion was denied - But Glasser was pretty harsh in his 12-page ruling. At the end he stated:

"At his sentencing he vehemently rejected the verdict of a jury that he was guilty beyond a reasonable doubt and the Court is unaware of a syllable of remorse that has fallen from his lips since. To grant this petition would be to depreciate the immeasurable negative impact upon society to which he has devoted his life."

What his lawyers said after government's oposition motion before final ruling:

"Mr. LoCascio’s motion does not minimize or whitewash the nature and circumstances of the offenses of conviction, Mr. LoCascio’s history, or the need to promote respect for the law and provide just punishment. However, the overarching principle of 18 U.S.C. § 3553(a) is that punishment should be “sufficient, but not greater than necessary,” to achieve the purposes of sentencing. After nearly 30 years of incarceration, the point of minimal sufficiency has long passed. At this juncture, it is wholly appropriate for justice to accommodate a measure of mercy in the face of Mr. LoCascio’s failing health amidst a global pandemic. His continued incarceration is neither necessary nor a good use of government resources. And despite BOP’s best efforts, FMC Devens cannot assure his medical care and safety “in the most effective manner.”

The tone of Glasser's entire ruling doesn't bode well for the evidentiary hearing either

Locascio's last card to play in this game called life is to come forth now and give up everything heknows about murders. Didn't he transport Milito's body from Tali's and drove away with it? Where did he bring it and who did he turn it over to? Inquiring minds want to know. it's your move Frank. And by the way mafia student - why not reprint Frank's sentencing speech where he praised and extolled how the world needs more John Gotti's?

These double standards with these judges. Guys like evanglista who in no way shape or form is reformed is release but Loc isnt. I think maybe thats why they do it. They know guys like evangelista will be back in jail in a month. But Loc wont be.

You know what it is? I'll tell you what it is, it's Anti-Italian American discrimination. Frankie Loc is a symbol of Italian pride. He's our guy, and they want to take it away.

He's quoting the Sopranos. Just substituting LoCascio for Columbus.

It's a new morning in America... fresh, vital. The old cynicism is gone. We have faith in our leaders. We're optimistic as to what becomes of it all. It really boils down to our ability to accept. We don't need pessimism. There are no limits.

Ah...lol. Thanks. Hate to admit it but I've never watched the Sopranos...maybe one or two episodes way after the fact. I don't have much patience for watching TV...ironic actually

Locascio's lawyers filed an appeal to the compassionate release denial.

They also filed a motion for the government to produce the following discovery material (see pic). Both filed 7/24/20. Thought some may be interested.

Few years ago some associate in rhode island have the feds the burial spot of a guy whacked in the 70tys. He was dying and I think under indictment but he said he wanted to clear his conscience. He died like a few weeks later. Always wondered if locascio would give DBs family that. He knows were hes buried. He didnt kill him was just doing what he was told
