“.. I .However, it was in the 90s that the Local was investigated by the Federal Government for charges stemming from alleged “ties with organized crime.”

Soon afterward, the Buffalo Laborers Local found itself placed under trusteeship for several years until the early 2000s.

While Peter Capitano had fingers pointed at him by the Federal Government, he was never charged with any formal crimes, his sons said.

“They ‘portrayed’ my Dad as a ‘mobster, a criminal.’ ‘He didn’t handle it well, but he still had his pension,’” Sam said.

The Federal Government’s investigation left Peter Capitano “with a bitterness,” son Peter said...”

“... Said Peter: “The vote was held from (8 a.m.) to midnight. It was tied and there were only forty ballots left - ‘and every single one went to Sam.’ ‘I will never forget that night.’ I said, ‘Bro, you pulled this off.’ ‘I was so proud.’ For my Dad, ‘it was vindication and Sam won it fair and square.’”

The Capitano Brothers were prepared for the coming cries of so-called and unfair negative influence that lingered from the past after the results of the election were made public...”
Sam Capitano is Special International Rep for the Northeast Region, overseeing seven Laborers Locals in Buffalo, Niagara Falls, Olean, Rochester, Syracuse, Ithaca and New York State’s North Country, which totals a combined 4,500 Members.

I've learned that that whole District Council concept for LiUNA was developed by a "confident" of Joe Todaro to help the Buffalo family exert influence & control over Laborers in vast areas of NY State.

From what I've been told they put Peter and Sam Fresinia into positions in this provisional Council to do their bidding. (See: https://laborers.tripod.com/laborersorg ... 14-98.html .) Additionally, Peter G. Gerace Sr. was the president and secretary-treasurer of the LIUNA from the time it was established in 1992 until it was disbanded in July 1994 and his wife Linda had a paid position in the Upstate NY District Council (See: https://jimmcgough.tripod.com/complaint.htm ).

Interesting that the District Council concept has been revived and Sam Capitano is now the Business manager of Update New York Laborers District Council developed by Todaro and his "confident." His brother Peter is an Auditor and Business Manage of Local 210 and Sam is the President of Local 210. Sam Capitano also serves a trustee on the following: New York State Laborers’-Employers’ Cooperation & Education Trust; New York State Laborers’ Health & Safety Trust Fund; and the New York State Laborers’ Political Action Committee.

Perhaps this is just coincidence and Sam is just a good manager committed to being a good influence for the Laborers' cause. Or perhaps he is still connected, after all he is a close friend with Joseph Bell III who has been described in court papers as an associate and perhaps a member Italian Organized Crime.
In his supplemental brief, Eoannou said, “Mr. Bella is accused of being a drug trafficker and a mob associate or member of ‘Italian Organized Crime,’ yet in three years the government has failed to prove he was a member of organized crime or that he sold drugs for money.”

Federal judge rules arrested Outlaws Motorcycle Club leader must remain in jail
Patrick Lakamp

John Ermin, who has been identified by federal prosecutors as international president of the Outlaws Motorcycle Club, must remain in custody as his firearms case proceeds in court, a federal judge ruled Wednesday.

Chief U.S. District Judge Elizabeth A. Wolford reversed a magistrate judge’s December order that had set conditions for his release.

…Snip…

Ermin, 54, of Lancaster, has not been charged with any crimes directly linked to the Outlaws, Pharaoh’s or the death of that witness, Crystal Quinn, the judge said. But the judge said she was not constrained to consider only the pending charge against him.

“It is not unreasonable to conclude that (Ermin) had a role in Quinn’s death,” Wolford said.

Wolford said she was not prepared to reach that conclusion based on the evidence disclosed by the government, which it has not fully revealed.

Judge orders separate trials for ex-DEA agent, strip club owner
Patrick Lakamp

The Pharaoh's strip club defendants will get their separate trials after all.

U.S. District Judge Lawrence Vilardo, who took over the case last summer, ordered separate trials Wednesday for Peter Gerace Jr., owner of Pharaoh’s Gentlemen’s Club, and retired Drug Enforcement Administration agent Joseph Bongiovanni.

Vilardo said "justice now requires severance of Bongiovanni’s case so that it may proceed expeditiously."

His ruling comes eight months after U.S. District Judge John L. Sinatra Jr., who previously presided over the case, ordered a joint trial.

...Snip...
Federal prosecutors in November moved to disqualify one of Gerace’s lawyers, delaying the Jan. 8 trial date that had been set for the two. Lawyers for Bongiovanni, who was indicted in 2019, did not want to wait months longer as prosecutors and Gerace's lawyers wrangle over Gerace's legal representation or for a potential replacement lawyer to come up to speed preparing for trial.

Prosecutors did not oppose Bongiovanni's request for a new trial, and neither did Gerace.

But Gerace requested a different type of severance. Rather than separate trials for the defendants, Gerace sought to sever the counts. He proposed the first trial cover all of the counts against Bongiovanni, and also the counts on which he and Bongiovanni overlap.

Gerace proposed a second trial just for the remaining charges against him.

Vilardo declined that request.

...Snip...

Prosecutors on Nov. 21 filed a document asking that Soehnlein be removed as one of Gerace’s two defense lawyers. The document plus related documents are sealed from public view, and the reasons for seeking his removal have not been aired in open court proceedings. Assistant U.S. Attorney Joseph Tripi said in court last month that information was uncovered that led to another investigation that caused a “conflict” for Soehnlein.

The government motion to remove Soehnlein triggered the delay that ultimately led to Vilardo ordering separate trials.

Prosecutor: Man who reported death of Pharaoh's witness offered 'hit-man services'
Patrick Lakamp

Since the first indictment in 2019, revelations in the Pharaoh’s strip club case have ranged from tawdry to tragic.

The latest disclosure from prosecutors borders on the bizarre – an alleged wannabe hit man misquoting phrases from a Martin Scorsese gangster film.

The man prosecutors say was offering “hit-man services” is the one who called 911 to report the death of a federal witness in the Pharaoh’s case.

Around the time Simon Gogolack reported the overdose death of Crystal Quinn – a former exotic dancer who had agreed to cooperate in the federal government’s sex- and drug-trafficking case against strip club owner Peter Gerace Jr. – he was trying to break into the hit-man business, according to the chief prosecutor on the case.

New indictment targets those who prosecutors say had motive to kill Pharaoh's witness
Patrick Lakamp

“A 28-count superseding indictment unsealed Tuesday names six people – including Pharaoh's Gentlemen's Club owner Peter Gerace Jr. and Outlaws Motorcycle Club national leader John Ermin – as part of a conspiracy to obstruct justice by targeting a federal witness for retaliation.”

Gerace Attorney 1' under investigation by feds in Pharaoh's strip club case
Dan Herbeck

“Federal prosecutors are investigating one of the region’s most high-profile attorneys in connection with a conspiracy that reportedly caused the death of a witness in the Pharaoh’s strip club case to prevent her from testifying.

“Although he is referred to as “Gerace Attorney 1” in an indictment made public on Tuesday, the indictment makes clear that attorney Steven M. Cohen is a subject of an investigation being conducted by the U.S. Attorney’s Office.”

In the video below Patrick Lakamp talks about covering the Gerace case. At 5 1/2 minutes Patrick indicates this case is less about Italian Organized Crime and more about women being preyed upon at Pharaoh's Gentlemen's Club and highlights the fact that the government is only proving that Bongiovanni thought he was protecting people in IOC.

Suspect in death of federal witness arranged drug deals while in jail, prosecutors say
Patrick Lakamp

"Sitting in jail did not stop Simon Gogolack from arranging drug deals, prosecutors say.

The Wellsville man charged in the overdose death of Crystal Quinn – a former exotic dancer who had agreed to cooperate in the federal government’s Pharaoh’s strip club sex- and drug-trafficking case – used another inmate’s telephone account to make calls to an accomplice on the outside, according to prosecutors.

“It’s all recorded on phone calls,” said Assistant U.S. Attorney Nicholas Cooper at a recent court proceeding."

Your instincts, [OcSleeper], again, are serving you well.

Iavarone's Information Sworn Date was Dec. 3, 2021.

He has a 10:00 am matter being heard tomorrow (Aug. 30) re: a trial continuation. I recently discovered when I went to a Toronto courtroom that hardly anyone is inside them, save the presiding justice, the clerks, the court reporters, and the odd Toronto Police Service officer. Almost all Ontario Court of Justice criminal matters throughout the province are being done via Zoom; so journalists themselves, e.g., Nicole O'Reilly, are following the matters virtually.

I have reason to believe she'll report on Iavarone's trial at some point. ;) ;)

The legal team for Peter Gerace is leaving nothing to chance
Ask for resources in case federal prosecutors move for death penalty, despite no indication that's even on the table
Dave McKinley
WGRZ NEWS

"Could indicted Pharaoh's Gentlemen's Club owner Peter Gerace be facing a potential death penalty?

Federal prosecutors have never stated that.

However, Gerace's lawyers appear to be taking no chances after the latest round of charges added to his case.

Already awaiting trial for alleged drug trafficking, sex trafficking, and bribing a federal drug agent, a new indictment recently unsealed now accuses Gerace and others of being part of a conspiracy to prevent a witness from testifying against him, by causing her death."
