Persico wasn't elected Boss in 1973. His pint is moot any way since he was part of the Commission for the other crimes during the 80s. Some of the young Philly guy's used similiar arguments after they were convicted in Rico case in 1988.

Who was the actual Boss of the Colombo's at that time, Persico is claiming he was not the boss during the commission bust?
The consensus is that Persico was elected as boss whilst in prison in 1973, and that he put Thomas DiBella, an aging, proficient capo, as interim boss. Carmine himself claims that he was not installed as boss until 1980, and therefore was not privy to discussions about Carmine Galante being whacked.

Avellino was indicted in a separate case, plus he was not a member of the Commission. The two indicted in the Commission case who weren't considered part of the Commission -- Scopo and Indelicato -- carried out crimes that the Commission conspired together to commit, namely the "Concrete Club" bid rigging scheme and the murder of Carmine Galante, respectively.
