In 2004, there was apparently a rumor within the Genovese family that Dom Cirillo's driver had provided info to Capeci. Peter Peluso, a lawyer closely tied with the Genovese family who passed on messages between the leadership, was recorded talking about Capeci's report that Mario Gigante would run the family following his supervised release, and how this info originally came from a conversation between Mario Gigante and Buster Ardito. Peluso discussed this with Ardito, who said that "the big guy" (supposedly Ernie Muscarella) wanted to kill Cirillo's driver for leaking the information. Capeci refused to say one way or another who the source was and said he was glad that Cirillo's driver was unharmed.
