If I recall correctly Scarpo/Lieber is tight with a Gambino member who supposedly went legit. That guy changed his surname and is now running a restaurant. I believe he's known as Sonny. Could be that Scarpo is a Mafia puppet.

After 1985 many of the bosses in Palermo received multiple life sentences and once they got arrested they remained official boss but they had zero power with absolutely no thought given about them. The acting boss or "reggente" became the real power and made all the decisions and took all the money. The reason for this was originally the idea the boss was boss for life and also because nobody in the commission really bothered to change the official bosses because this was Riina's decision.

After 1992 the commission was not really operating. It was only a few bosses who were making the decisions and let's be clear most of them were reggente or acting. They didn't care to push to change the official boss because it changed nothing in day to day affairs and the commission wasn't really operating which would give approval to such appointments. This continued until 2008 when they decided to create a new commission and re-organize the families.

New York looks to be in the position where Palermo was between 1985-2008. Nobody cares to change the official boss and the commission -if it still exists - doesn't bother to force the idea of appointing a new official boss.
