I hate to be that asshole, especially because I personally don’t think the evidence was enough to convict Spataro. With that being said, Spataro’s use of Lisa Ida as a Defense witness to testify that she was with Spataro at his body shop at the time of the shooting is not really a big deal in the grand scheme of the case. Nobody is saying Spataro shot Campanella. In fact, Floridia himself wasn’t confident that Spataro dropped of DeMartino to the murder scene on the day. Spataro’s conviction mainly hinged on the fact that Floridia testified extensively that Spataro was somewhat involved in the planning of the hit and passing messages from John DeRoss down the chain of command, as well as the fact that DeMartino made a flurry of calls to Spataro moments after the hit, with Floridia testifying that DeMartino was heard over the phone saying “Mike, we missed.”

Is Spataro guilty of murder conspiracy? Ehhhh, I think a more accurate crime would be misprision of a felony, which is what Barney Bellomo pleaded guilty to back in the day. It essentially means you knew a felony was going to be committed but did nothing to stop it or report it to authorities. In Spataro’s case, just like in Bellomo’s case, the felony in question was murder.

Spataro’s alleged role in the hit was as a messenger in the three months of planning and preparation. What he did on the day itself had no bearing in his conviction. Prosecutors heavily inferred that Spataro dropped off the trigger man, Vincent DeMartino, to the murder scene because Floridia recalled seeing an unrecognisable car drop off DeMartino and Floridia knew that Spataro often drove his client’s cars.

This is also points to the example of Emilio Fusco who got 25 years. In his case he was appealing to the fact the feds said he was a made member and he was disgusting it. This is what got Bruno killed as well. Getting whacked, disgusting court cases all being or not being a made guy.
It raises your profile, but also get you extra time and whacked

Crea may be getting fucked in this case but I would think that the broader ramifications of that verdict could in theory be the beginning of the end for the mob. No? Why the hell would anyone want to be a boss or an underboss if you can catch a life sentence for any murder that they connect to your family, even if they can't prove you personally had shit to do with it? So why get made at all then. We have seen examples of guys turning down membership over the years and you gotta think that will only increase. Eventually the families will just die off if nobody wants to get made or get promoted to a leadership position. On paper that would be the goal of the Justice Department and the long-awaited victory of a war that has dragged on for decades but I think there will be a lot of people in law enforcement crying the blues if the families die out. FBI probably has enough high-level CIs to keep the whole game going for as long as possible.

. Completely forgot Misprision of a Felony was even a thing, or that it was used against Barney Bellomo.

I can’t remember how much time Barney served for his misprision of a felony because I know he was awaiting trial for awhile before he bargained down the murder conspiracy to misprision of a felony. Hell, he might’ve even gotten time served.

Spataro, on the other hand, was a half-a-wiseguy even during the whole Campanella murder plot. Why do I say this? Both law enforcement and Spataro’s defence are in agreement that Spataro was a lawfully employed mechanic who owned and operated Narrows Body Shop five days a week. Of the handful of ex-Cutolo informants on the witness stand, none of them could point to any specific crimes Spataro was involved in after his release from prison in the ‘90s, apart from a general idea that he was involved in loansharking. Joe Campanella testified extensively about crimes committed by Spataro in the ‘80s and Colombo war, but nothing after that. Giovanni Floridia was a six-figure loanshark who used Spataro’s body shop as a regular meeting place. Again, no testimony about crimes committed.

Oh, there’s one exception. Silvio Salome, who - to be brutally honest - was one of the least reliable people on the witness stand for several reasons which I will save for another post. Salome testified that when he crashed his car, Spataro jacked up the cost for the insurance company. Salome did not indicate that this was some sort of ongoing hustle of Spataro’s.

However, all the witnesses were in agreement that Spataro was on record with his old pal, best friend, and hit team accomplice Vincent DeMartino. I can’t fathom why Spataro was not recruited as an actual, physical member of the Campanella hit team over Giovanni Floridia, unless Spataro specifically didn’t want to. I say this because Spataro was a player during the 90s war, as I’ve mentioned before. I posted his “hit list” that cops found on him in the Mugshots section some months ago.

I know Pogo and Wiseguy probably want Spataro locked up for good, as per usual

, but I really don’t think he served any purpose whatsoever in having Campanella killed. There is no direct evidence that Spataro did anything in particular to further Campanella’s death, and it’s laughable to suggest that the decision to murder Campanella hinged on whether DeMartino and Floridia met at Narrows Body Shop or at Dunkin’ Donuts.

"You have to know your people," he said. "I know my people quite well. I've served south Queens for 19 years now. I'm here about five years now. I've learned a lot about the people I serve. They're a very earthy type," he chuckled, just a bit.

The padre is in a tough spot. He handled that very diplomatically, with a touch of humour.
