Adler sent his letter May 22 and also copied the court (see below). In addition, I've reposted (can't remember if I posted earlier) the Judge's order that the BOP look into a furlough until the Covid crisis is over. Also just an FYI, DiNapoli NEVER requested a reduction in sentence as has been stated elsewhere. Siebel states in her ruling (she does not give written rulings only verbal) that he only served three months of his sentence to date. All docs taken from PACER.

So, it's been two weeks and DiNapoli has not heard from the BOP regarding the judge's order to look into compassionate release because even though she had the authority she decided to "pass the buck" as Capeci said. We've reached out to the warden to see what's up and will let you all know the results.

Joe DiNapoli is still fighting! Hopefully he'll be released soon like he deserves to be! Home confinement until the crisis is over so he can take care of his diabetes. Simple.

Siebel didn’t even hold a hearing to explain why she was giving this man a sentence longer than the one he agreed to in his plea in which he had pled guilty to “running a gambling operating obligations from bettors on unsuccessful wagers.”
It's things like this that need to be brought out more.

So according to Bert random legitimate citizens are overhearing mob bosses ordering murders. Who would have thunk it. :lol:


They get wiretaps without informants all the time, you need to follow OC a bit more.

They do? Since it happens all the time I'm sure you'll have no trouble at all listing some examples of it.

Who is "we?" You are all ears. No brains but great ears. :lol: A witness can be a citizen who heard something
co-oberating a tape, or a video . They get wiretaps without informants all the time, you need to follow OC a bit more.

You're not explaining how a law abiding citizen can "see something or hear something" about organized crime murders, conspiracies and operations. And how can the FBI or any LE get probable cause for a wiretap warrant without using informants?

FBI can catch it on tape, or other means. Maybe they can't, and they didn't. Rats get caught lying too much, which Mafiastudent points out in one of her stories that set you off. You just don't like the other side being presented. No proof he ordered it, no trial. He is innocent on the charge. If you get arrested for something you did not do, and a friend arrested with you is facing life, he may get a deal to say you are guilty in order to free himself and take it. It happens outside of organized crime too often. It can't and should not be ignored.

Exactly. First of all, not all Informants lie. That is a general unproven statement. The Defense team can cross examine the Informant like I stated. Let's not forget that fact. Defense Attorneys are brutal & usually better than the Prosecuting Attorneys. That's why the Defense Attorneys have their own Practices & don't work for the D.A.
If all Informants were not allowed to testify (even though they can be cross examined by the Defense) then you might as well make Organized Crime Legal & just forget about it.
