The judge should not be allowed to sentence based on previous acquittal charges.
Asaro should have not had his people torch the car. Unbelievably stupid move IMO.

Regardless of the Guilt or Innocence in this matter - Sentencing on the basis of a previous ACQUITTAL is just wrong.

No one said any of these guys were remotely smart. How many intelligent 77yr olds do you know order a bunch of knuckleheads to torch a car? Most of the smart ones I know are playing poker at the clubhouse down in Del Boca Vista Phase II.. Asaro is going right where he always belonged..lol

I could've sworn that Vinny's crew was split from Jerry's but I don't know where I got that information from.

I made a couple of mistakes here. Thanks for pointing them out.
I should've said 2013-2015 for Palmaccio. Palmaccio had to have been made during this timeframe because he was indicted as an associate in 2011 and got a year or two for gambling, if I remember correctly. I don't actually remember where I got the information about Festa from, but I think it was from what Capeci called him in his articles.

As for the Giallanzo thing, I was wrong. No idea where I got the date 2000 from but it must have come from before the 2017 indictment, because the 2017 indictment has the crimes spanning from 1998-2017, and says that "at all times relevant to this indictment," Giallanzo was a soldier or acting capo, which means that he had to have been made before 1998.
Also, in June 1999, Giallanzo was described by the Independent Review Board as a "nephew to organized crime member Vincent Asaro," not an organized crime member himself. So this means that the IRB, which gets its information from the feds, didn't know Giallanzo was made at that time.

there was a article stating exactly that.... where the judge said they basically believed he was guilty of more such.

i thought the whole point of the guidelines was so the judges couldnt do exactly what happened here.

the guidelines are based off of points of previous crimes and current and they add up points and figure out how much time whoever is going to get. i had state cases and i remmember my lawyer saying they have to comply with the guidelines...

Sure his past hurt him , I belive it was because of allegallly threating a prosecutor also he had a civilians car torched over a traffic dispute .

The judge was also the same judge who presided over the Lufthansa case, and apparently thought he was guilty of the murders, re-burying the body, etc. The fact that Vinny was acquitted astonished the judge, the prosecutors, the defense, even Vinny himself.

I'm pretty sure they are counting the time he was held for the airport heist and now , so I think he has over 3. Years in already so 85 percent of 8 years is aroun 6 years and 7 months minus the 3 years served so he can be out in 3 years or so , I'm not 100 percent sure but I think they are counting that time

Absolute bullshit a judge can hit him with time for a previous charge of which he was acquitted.
Sorry, but it’s bullshit.
A jury, presented with both sides, with no impropriety, acquitted him.
This has to be respected. The system has to be respected.
Because it’s not about his particular innocence or guilt in this particular case, it’s about the integrity of the system and the protection of rights to all.
Sure he was guilty. But one guilty guy getting lucky should not affect the abilities of the system to degrade the institutions and processes which ensure constitutional rights.
One bad guy getting lucky should not risk the future rights of trial by integrity and due process.
If a judge can overrule the jury, then what point a jury?
Where is the right of a trial by peers if that is disregarded on opinion?
The judge doesn’t have to like the juries verdict, but the judge MUST respect it. Opinion aside.
In this case the judge has disregarded a fundamental process in the rule of law. This should be deeply concerning to all. And this isn’t about Vincent Asaro’s guilt or innocence.
It’s about the protection to all afforded by a system based on constitutional rights which today became a lot weaker.

In other words, a small good thing in getting Vinnie off the streets but a huge ass fuck to countless more who’ll get fucked by this precedent.
